SERVICES OF HEIRS IN SCOTLAND 1700-1855

To be served heir on the death of a Scottish landowner, the claimant could not succeed to the lands until his/her right had been proved.
This involved sending a Brieve of Inquest by the Chancery to to the Sheriff of the county
where the lands were situated, which required the Sheriff to enquire into the claimants right of succession.
The findings were then sent back (retoured) to the Chancery and recorded in the Record of Retours.
The Services of Heirs is an index to these retours.
NOTE the dates, unless otherwise specified, relate to the retour and NOT to the date fo death of the landowner.
Retours can relate to property whoes original owner may have died years or even decades before.
Also not all property was retoured as some was simply passed on during
the owners lifetime, or after his death without any recourse to legal proceedings.
